Terms & Conditions & FAQs
These Terms & Conditions refers to “the client”, “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person added to a booking or to whom a booking is transferred.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:
declares that he/she and all members of the party are of the appropriate age to purchase those services. In our relationship with you we, Villa Olivo, act as the Principle. We sell villa accommodation (“Accommodation Services”) as a Principal and our obligations are those of a Principal.
We may agree to provide you separately with individual holiday experiences and extras and if that is the case then in relation to those elements (“Extra Services”) we act as an Agent on behalf of the suppliers. Our various and differing obligations are set out below, in three separate sections.
You may decide to just purchase Accommodation Services, or you may decide to purchase Accommodation Services and Extra Services (e.g. Yoga classes, cooking classes etc). Whatever you decide, we will treat each element as a separate booking so that the price charged in total for the booking of more than one element will always equal the prices charged separately for each individual element. In our invoicing we will separate out Accommodation Services where we will be acting as a Principal from any Extra Services where we will be acting as an Agent.
1.1 When you make a booking, you confirm that you have the authority to accept and do accept these conditions on your behalf and on behalf of all members of your party and further, if you are making a booking for more than one person, that you are responsible for all payments due from each and every member of your party. It is your responsibility to ensure that any information which
you give us is accurate and that information which is given to you by us or any of our suppliers is passed on to all members of your party.
The “Party Leader” is the person in whose name the booking is made and to whom all correspondence and invoices are addressed and as such is responsible for the rental. Spouses’ names are not considered interchangeable.
The term clients shall refer to members of the party and in this context does not solely refer to the Party Leader.
You will be required to make full payment for your booking at the time of booking. Should you be requested to you only pay a deposit you must pay the full balance by the balance due date notified to you.
3.1 If full payment is not received by the balance due date you, in respect to a booking of Accommodation Services, will be subject to our cancellation charges, see section B below.
3.2 Alternatively, where you have booked Extra Services, we will notify the supplier who may cancel your booking and charge the cancellation fees set out in their terms and conditions. You will be subject to such terms and conditions and must familiarise yourselves therewith. We can supply these to you on request.
3.4 A Damage security deposit of Euros 1000 will be required in addition to the rental fee. This is 100% refundable within 7 working days of your departure, provided the following provision are met:

We strive to ensure accuracy of descriptions shown however we are not always able to control all the components of the holiday arrangements and it is possible that an advertised facility may be withdrawn or changed.
If you have any special requests, please let us know at the time of booking. We do not guarantee that they will be met, and we cannot be held liable if they are not.

10.3 You and/or your party may also be required to pay for loss and/or damage caused by your actions, and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party. You agree to indemnify us for the full amount of any claim (including all legal costs) made against us by the supplier or any third party as a result of your conduct.
All documents (e.g. invoices/tickets) will be sent to you by e-mail. Once documents leave our offices, we will not be responsible for their loss unless such loss is due to our negligence. If tickets or other documents need to be reissued all costs must be paid by you. You can ask for delivery by other means subject to payment of the necessary charges.

13.1 Where we are acting as a Principal (in the sale of Accommodation Services), please inform us immediately in the event of a complaint and contact us on the numbers listed on our website or on your confirmation documents. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to us giving your booking reference and all other relevant information. It is strongly recommended that you communicate any complaint regarding the
services in question without delay and complete a report form whilst at the Villa. If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and address your complaint whilst you were in resort and this may affect your rights under this contract.
Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier of the service in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and all similar events outside our or the concerned supplier’s control.
Villa Olivo has Public Liability Insurance with a proprietary Insurance Company as required by law.
These terms and conditions are governed by English law and any dispute arising between the parties is subject to the exclusive jurisdiction of the courts of England and Wales.
For all correspondence, it is agreed that both parties accept documents transmitted by electronic means.
(1) Subject to the remainder of this clause 18, we have a duty to select the suppliers of the services making up your booking with us with reasonable skill and care. We have no liability to you for the actual provision of the services, except in cases where it is proved that we have breached that duty and damage to you has been caused. Therefore, providing we have selected the suppliers/subcontractors with reasonable skill and care, we will have no liability to you for anything that happens during the service in question or any acts or omissions of the supplier, its employees or agents.
(2) We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:
(a) the act(s) and/or omission(s) of the person(s) affected; or
(b) the act(s) and/or omission(s) of a third party; or
(c) unusual or unforeseeable circumstances beyond ours or our supplier(s) control; or
(d) an event which either ourselves or suppliers could not have foreseen or forestalled.
(3) We limit the amount of compensation we may have to pay you if we are found liable under this clause:
(a) Loss of and/or damage to any luggage or personal possessions and money.
The maximum amount we will have to pay you in respect of these claims is an amount equivalent to the excess on your insurance policy which applies to this type of loss per person in total because you are assumed to have adequate insurance in place to cover any losses of this kind.
(b) Claims not falling under (a) above and which don’t involve injury, illness or death.
The maximum amount we will have to pay you in respect of these claims is twice the price paid by you in total for your booking with us. This maximum amount will only be payable when you have not received any benefit at all from your booking.
(4) It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves strictly in accordance with the complaints procedure set out in these conditions.
(5) Where any payment is made, the person(s) receiving it (and their parent or guardian if under 18 years) must also assign to us or our insurers any rights they may have to pursue any third party and must provide us and our insurers with all assistance we may reasonably require.
(6) Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description:
(a) which we could not have foreseen you incurring, on the basis of the information given to us by you concerning your booking prior to our accepting it; or
(b) relate to any business.
(7) We will not accept responsibility for services or facilities which do not form part of our agreement or where they are not advertised in our advertising material.

24.1 It is a condition of your contract with us that the number of people staying at the villa throughout the rental period must never exceed the number of sleeping places indicated in the property description and confirmed on the Villa Olivo website. Exceptions to this are occasionally made for children under the age of 2 years old only; provided they are sleeping in a crib or cot and not occupying one of the Villa’s bed or rooms – please contact us at the time of booking as to whether this exception will apply.
24.2 Should the composition of your party as detailed in the booking form change prior to the rental period, you must notify us promptly in writing, additional charges may be payable as a result.
24.3 At certain times of the year some of our properties are offered at a discounted rate for smaller parties. Should a booking be made on this basis it can be changed at any time to accommodate a larger group up to the maximum number of people allowed at that property. In these cases an additional charge will be applied according to the revised numbers

Should departure prior to that be necessary, please notify us at the beginning of the rental period in order to arrange an alternative time for the property inspection. If you choose not to be present at the inspection, you will not be entitled to query the Final Bill, and you will be invoiced for the amount indicated plus the Euros 75.00 administration fee. This may be taken from your damage deposit.

If the supplier offers alternative arrangements or a refund, you will need to let us know your choice within the stipulated time frame. If you fail to do so the supplier is entitled to assume you wish to receive a full refund and that would be in full and final settlement of any claim you might have in respect thereof. We accept no liability for any changes or cancellations made to your arrangements by the supplier under your contract with it.
The Final Bill includes lists of the specific costs of Extra Services booked in advance which are to be paid locally. On our web site we list charges as a guide only and variations may occur depending on prevailing conditions, we cannot guarantee these charges.
Extra Services booked on the spot will also be charged locally. The Final Bill is presented by the Villa Owner/caretaker at the conclusion of the rental period and is payable to him/her in Euros (cash) or by Credit or Debit Card. Both the Party Leader and the Villa Owner/caretaker are required to sign the Final Bill.
The Party Leader is liable for any damages caused to the property, its contents or grounds by any member of the party or the loss of any articles belonging to the property.
Charges for breakages or repairs caused by the party staying at the villa will be noted during the final inspection. Charges that can be calculated on the spot will be added to the Final Bill. However, the charges that cannot be quantified immediately will be calculated and billed to Party Leader at a later date. These charges include (but are not restricted to) for damaged or lost articles and other damages for which the repair/replacement estimates are not available. These charges can be taken from the damage deposit taken on arrival.
Under extreme circumstances, the amount shown on the Final Bill may be invoiced and paid through Villa Olivo on the understanding that a Euros 75.00 administration fee will be added to the amount due. The amount of the Final Bill in Euros (€) will be invoiced in the same currency of the booking, at the rate given by the Financial Times of London on the Monday following departure.
In the event of a disagreement regarding the extent of the damage or the cost of the repairs or lost articles, clients must call Villa Olivo immediately and speak directly with a staff member before leaving the property.
The Final Bill, for Extra Services and utilities which will be presented by the Villa Owner/caretaker of the property at the end of the rental period, must be paid directly to him/her in Euros (€).
Extra Services are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions which will form part of your contract with them with us acting as agent. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable International Conventions.
